Caldwell Cassady & Curry Win for VirnetX Affirmed in $439 Million Judgment

Dallas law firm helps internet security software, technology company prevail over Apple

DALLAS – A Texas federal judge has entered a $439.7 million patent infringement judgment against Apple Inc. (NASDAQ: AAPL) following a verdict won last year by attorneys from Dallas’ Caldwell Cassady & Curry in favor of Nevada-based VirnetX Inc. (NYSE MKT: VHC), an internet security software and technology company.

The case focused on internet security patents owned by VirnetX that Apple used without permission to produce popular features such as FaceTime on the company’s iPhones and other products.

The judgment handed down Sept. 29, 2017, by Judge Robert W. Schroeder III in the U.S. District Court for the Eastern District of Texas affirms a $302.4 million verdict won by Caldwell Cassady & Curry on behalf of VirnetX in September 2016. The case is VirnetX Inc., et al. v. Apple Inc., No. 6:10-CV-417.

In addition to the verdict amount, the court also ordered Apple to pay more than $41 million in enhanced damages and more than $96 million in court costs, attorneys’ fees and prejudgment interest.

The Caldwell Cassady & Curry attorneys who successfully represented VirnetX are name principals Brad Caldwell, Jason Cassady and Austin Curry; firm principal Justin Nemunaitis; and firm associates Hamad Hamad, Warren McCarty, Daniel Pearson, Christopher Stewart and John Summers.

“VirnetX is a company made up of good, decent people who invented groundbreaking technology. It’s nice to see good things happen to good people, and we are grateful that the court fully affirmed the jury’s verdict,” says Mr. Cassady.

The lawyers at Caldwell Cassady & Curry have successfully represented VirnetX in three separate patent infringement trials against Apple since 2012, with jurors awarding VirnetX more than $1.2 billion.
